1. Introduction and Acceptance
These Terms of Service ("Terms") govern your access to and use of the Oathe platform, website, API, and related services (collectively, the "Service") operated by Oathe ("we", "us", or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Description of Service
Oathe is a behavioral security platform for AI agents. The Service includes:
- Automated security audits of AI agent behavior
- A dashboard for viewing audit results and trust scores
- An API for programmatic access to auditing capabilities
- Public trust score badges and reports
3. Account Registration
To access certain features, you must sign in using Google OAuth. By signing in, you:
- Authorize us to access your name and email address from Google
- Confirm that the information provided is accurate
- Accept responsibility for all activity under your account
You must not share your account or allow unauthorized access. Notify us immediately at [email protected] if you suspect unauthorized use of your account.
4. Acceptable Use
You agree not to:
- Use the Service to conduct denial-of-service attacks or otherwise abuse the platform
- Attempt to reverse engineer, decompile, or extract the source code of the platform or its auditing methodology
- Misrepresent, fabricate, or tamper with audit results or trust scores
- Use the Service for any unlawful purpose
- Interfere with or disrupt the Service or its infrastructure
- Submit malicious code designed to attack Oathe's infrastructure (as opposed to legitimate agent behavior being audited)
5. Intellectual Property
Our property: The Oathe platform, auditing methodology, scoring algorithms, website content, and branding are our intellectual property or that of our licensors. You may not copy, modify, or distribute them without permission.
Your property: You retain ownership of any agent code, configuration, or data you submit for auditing. By submitting data, you grant us a limited, non-exclusive license to process it for the purpose of providing the Service.
Audit results: Audit reports and trust scores generated by the Service are licensed to you for use in accordance with these Terms. You may publicly display your trust scores and badges.
6. API Terms
Access to the Oathe API is subject to rate limits based on your plan tier. We reserve the right to:
- Throttle or suspend API access for abusive usage patterns
- Modify rate limits with reasonable notice
- Revoke API access for violations of these Terms
7. Audit Results Disclaimer
Audit results, trust scores, and reports generated by the Service are provided for informational purposes only. They are:
- Not a substitute for professional security advice or a comprehensive security assessment
- Not a guarantee or certification of an agent's safety or security
- Based on behavioral analysis at a point in time and may not reflect subsequent changes
You should not rely solely on Oathe audit results when making security decisions. We recommend using our results as one input in a broader security evaluation process.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OATHE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify, defend, and hold harmless Oathe and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
11. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.
12. Third-Party Services
The Service integrates with third-party providers including Google (authentication), Anthropic and OpenRouter (AI analysis), Hetzner (hosting), and Cloudflare (CDN). Your use of these third-party services is subject to their respective terms and privacy policies.
13. Modifications
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Material changes will be communicated via email or a prominent notice on the Service. Continued use after changes constitutes acceptance of the revised Terms.
14. Termination
By you: You may stop using the Service at any time. To delete your account, contact us at [email protected].
By us: We may suspend or terminate your access if you violate these Terms, abuse the Service, or for any other reason with reasonable notice. In cases of serious violations, termination may be immediate.
Upon termination, your right to use the Service ceases. Sections that by their nature should survive termination (e.g., disclaimers, limitations of liability, indemnification) will survive.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.
16. General Provisions
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
- Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Oathe regarding the Service.
- No waiver: Our failure to enforce any provision does not constitute a waiver of that provision.
- Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights without restriction.
